Welcome to OnePet - Pet Care & Training, a mobile application ("App") owned and operated by PinkLife ("Company," "we," "us," or "our"). These Terms and Conditions of Use ("Agreement") govern your use of the App. By accessing or using the App, you agree to be bound by this Agreement and our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, do not use the App.
Licensed Application End User License Agreement
Apps made available through the App Store are licensed, not sold, to you. Your license is subject to your acceptance of either this Licensed Application End User License Agreement ("Standard EULA") or a custom end user license agreement between you and the Application Provider ("Custom EULA"). The license is granted by Apple for Apple Apps and by the Application Provider for Third Party Apps. The Licensor reserves all rights not expressly granted under this Standard EULA.
a. Scope of License: You are granted a nontransferable license to use the App on Apple-branded products, subject to the Usage Rules. You may not distribute the App over a network where it could be used by multiple devices simultaneously. Reverse engineering, modification, or redistribution of the App is prohibited.
b. Consent to Use of Data: Licensor may collect and use technical data for software updates, product support, and other services. Information used is in a form that does not personally identify you, aiming to improve products or provide services.
c. Termination: This Standard EULA is effective until terminated by you or Licensor. Your rights terminate automatically if you fail to comply with any terms.
d. External Services: The App may enable access to Licensor's and/or third-party services and websites ("External Services"). You agree to use External Services at your sole risk. Licensor is not responsible for third-party External Services.
e. NO WARRANTY: The App is provided "as-is" and "as-available." Licensor disclaims all warranties and conditions, express or implied.
f. Limitation of Liability: Licensor shall not be liable for any indirect, consequential, or incidental damages arising from your use of the App.
g. Export Compliance: You may not export the App except as authorized by the law.
h. Commercial Items: The App and related documentation are "Commercial Items" licensed to U.S. Government end-users.
i. Governing Law: This Agreement and the relationship between you and the Company shall be governed by the laws of Romania. Any dispute shall be resolved by arbitration in accordance with the rules of the Romanian Arbitration Association.
License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use only. Copying, modifying, or transferring the App without our prior written consent is prohibited.
User Content
The App may allow you to submit user-generated content, retaining ownership but granting us a license to use it for any purpose.
Advertising
The App may contain third-party advertisements. Interactions with third-party advertisers are solely between you and them.
Premium Subscription
The App may offer a premium subscription service for an additional fee. By subscribing, you agree to pay the applicable fees, and we may charge your chosen payment method until cancellation.
Termination
We reserve the right to terminate this Agreement and your access to the App at any time, without notice or liability.
Disclaimers and Limitations of Liability
The App is provided "as-is." We are not liable for any indirect, consequential, or incidental damages arising from your use of the App.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Romania. Any dispute shall be resolved by binding arbitration in accordance with the rules of the Romanian Arbitration Association.
Miscellaneous
This Agreement constitutes the entire agreement between you and us, superseding any prior agreements. If any provision is found to be invalid, remaining provisions shall remain in full force. Our failure to enforce any right shall not be deemed a waiver.
